This Privacy Notice (this "Notice") is applicable to the TalentSIM assessment and related services (collectively, the "Services"). This Notice describes how Mercer (US) Inc. and its affiliates (collectively, "Mercer") collect, use and share the personal data you submit through the Services. This Notice applies solely to the Services, and does not apply to the practices of companies that we do not own or control, to persons we do not employ, or to websites we do not own or operate.

 

By accessing, browsing, or using this website or these Services, you acknowledge that you have read, understood, and accepted the practices described in this Notice and the Terms of Use. Please read this Notice carefully and be aware that we may change it from time to time to reflect industry initiatives or changes in the law, the collection of and/or our practices relating to PII and Related Data, the features of these Services, or technology. We will notify you of such modifications through these Services. Your continued use of these Services after receipt of such notice signifies your acceptance of the modified Notice. Accordingly, it is important that you review any notifications regarding this Notice, as well as regularly review the Notice, to ensure that you are aware of any changes to our Notice.

 

The Services are intended for adults. If you are not yet 18 years old or lack the legal authority to form legally binding contracts under applicable law, please do not use the Services. We do not solicit or knowingly collect any information from visitors under 18 years of age.

Use of the Services

There may be optional or ancillary services offered to you through the Services; use of these Services and making choices to receive information or offers of such optional or ancillary services, constitutes your authorization pursuant to applicable state and federal laws to Mercer to use this information to fulfill your requests.

Personal Information and Information We Collect

Personal information includes both personally identifiable information ("PII") that we maintain and process on your behalf, typically including your full name and email address, as well as data that can, under certain circumstances, identify you as an individual ("Related Data"). Depending on the nature of the services we are providing to you, your PII may also include:

  • contact information, including address; and
  • employment-related information.

Mercer operates these Services and administers the programs offered through the Services. In this role, Mercer has access to your PII and Related Data for purposes of performing those services. For these purposes, we may also:

  • (a) collect:
    1. i. contact information and other information that identifies you personally,
    2. ii. demographic information, or
    3. iii. e-mail addresses and other information you provide when you send us e-mail messages;
  • (b) request other information from you; or
  • (c) provide you information when you use these Services.
  • We will also collect information reasonably necessary to evidence your instructions to us concerning your choices and elections in relation to the services we provide.

     

    Mercer collects domain names of visitors to the Services to measure the number of visits, pages viewed, and average time spent on the Services.

     

    We create aggregate reports on user demographics and traffic patterns. These aggregated statistics are used internally to better provide services to our users and may also be provided to advertisers, sponsors, and partners but again, they contain no individual personal information and cannot be used to gather such information. This allows our advertisers, partners, and sponsors to advertise more effectively, and allows our users to receive advertisements that are pertinent to their needs. Because we don't track the usage patterns of individual users, an advertiser, partner, or sponsor will never know that a specific user clicked their ad.

     

    Your credit card or payment information is collected by a third-party payment processor to process the payment and remit it to us; we do not receive credit card information from you.

    Links

    The Services may contain links to other sites that are linked to or integrated with the websites operated by organizations other than Mercer or that you may have used to access the Services. Mercer is not responsible for the privacy practices of websites operated by any other parties that are linked to or integrated with these Services. When you are on another party's website or once you have left the Services via such a link, you should refer to those websites' separate privacy policies and practices to determine how they will handle any PII and Related Data they collect from you.

    Tracking Technologies

    Your use of these Services may be tracked so we can deliver information to you that you may find interesting while you are using the Services. We may also analyze your history of using the Services by collecting data generated by your activities, including through the use of cookies. Your history of using the Services may also be analyzed for quality improvement and control, security and system monitoring purposes, or to measure the number of visits, pages visited, and average time you spend on the Services.

     

    A cookie is a small text file that a website stores on your computer to identify you during a visit and between visits. Like many other sites, the Services use "cookies" to enable the systems to recognize your browser and to navigate the Services more easily. For all visitors to the Services, cookies are used to collect clickstream data, including: the Internet protocol (IP) address used to connect your computer to the internet; computer and connection information such as browser type and version, operating system, and platform; the Uniform Resource Locator (URL) from which you linked to the Services; and possibly, certain other Web protocol header information.     If you disable cookies, functionality of the website may be inhibited, and we cannot guarantee that the Services will function properly or present to you through your browser correctly.

    Sharing and Disclosure Information

    We do not sell or otherwise disclose your PII and Related Data to third parties, except as described here.

     

    Your Instructions: We may share information you submit on or to these Services solely for and in connection with the provision of service(s) you have requested from Mercer. As well, you may select from optional services, if offered, and if you do so, we will act on your instructions to share your information in order to fulfill your requests.

     

    Agents and Contractors: Your PII and Related Data may be shared with other outside contractors or agents who perform services for Mercer to help manage and run these Services. These other companies may be supplied with or have access to your PII and Related Data solely for the purpose of providing such services to Mercer. Included in this group are payment processors, who handled your credit card information on our behalf in order to facilitate payment; Mercer does not obtain access to your credit card information.

     

    Mercer Companies: Mercer may also share your PII and Related Data with Mercer's affiliates and subsidiaries to perform services for you.

     

    Legal Matters: Unless otherwise described above, Mercer will not share your PII and Related Data with other nonaffiliated third parties, except Mercer may disclose your PII, Related Data, or non-PII, to the extent required or permitted by applicable law, in order to: (a) protect or defend its legal rights or property, or the rights or property of its employees, agents and contractors (including enforcement of its agreements); (b) protect the safety and security of users of these Services or members of the public, including by acting in urgent circumstances; (c) protect against fraud or for risk management purposes; and (d) comply with the law or legal process.

     

    Business Transfers: In addition, if Mercer sells all or part of its business or makes a sale or transfer of all or a material part of its assets, or is otherwise involved in a merger or transfer of all or a material part of its business, then subject to applicable law, Mercer may transfer your PII, Related Data, and any other information you have submitted to the Services to the acquiring party or parties, or to their advisors, as part of that transaction without your consent or notice to you.

     

    Testimonials: We may publicly post testimonials and other feedback we receive from you. If you wish to have your testimonial removed, you can contact us as specified below.

    Security

    Mercer maintains the Services and all associated data with technical, administrative, and physical safeguards intended to protect against loss, unauthorized access, destruction, misuse, modification, and improper disclosure. The information you enter on the Services, including your username and password/PIN, are stored securely on data servers. However, no computer system or information can ever be fully protected against every possible hazard. Mercer is committed to providing reasonable and appropriate security controls to protect the Services and its information against foreseeable hazards. You must maintain the confidentiality of your username and password/PIN, and are responsible for restricting unauthorized access to your computer.

    Storage of and Access to Information

    All information that you submit through the Services is collected, stored, and processed in the United States; however PII and Related Data you provide to us may be accessed by Mercer, and other contractors of Mercer around the world.

     

    Mercer has established records retention policies for the jurisdictions in which we operate. Mercer is obligated by law to retain your personal information for varying periods of time, depending on the nature of the information and the legal requirements of the applicable jurisdiction. Accordingly, portions of your records may be retained for periods of time different than for other portions, depending on the nature of the records and which jurisdiction's laws applies to them. We are also required to maintain records to comply with our own business requirements, and for reasons that include evidencing our work and providing materials to comply with the requirements of an audit.

     

    We may also retain your information for a period of time in backup systems as a precaution against system failures, or as required to meet obligations to retain records in the event of a dispute or legal action in which we or our clients, may be involved. While you cannot request that personal information be deleted, we keep your personal information secure, and we will dispose of PII as soon as practicable after we have fulfilled our retention requirements.

    California Privacy Rights

    YOUR PRIVACY RIGHTS - California Civil Code Section 1798.83 permits users are California residents to request certain information regarding the disclosure of any personal information to third parties for their direct marketing purposes.
